Terms of Service

1. Agreement

These Terms govern your use of THEILKER MARKETS at saas.theilker.com (the "Service"). By creating an account or using the Service you agree to these Terms, the Privacy Policy, the Refund Policy and the Risk Disclosure. If you do not agree, do not use the Service.

You must be at least 18 years old and legally able to enter into this agreement.

2. The Service

The Service provides market information and analytics: algorithmic strategy signals, charts and indicators, economic calendar, news aggregation, social-media sentiment, live government broadcasts with automated speech analysis, and order-book data.

All content is general information for educational and informational purposes only. It is not investment, financial, legal or tax advice, and it is not a recommendation or solicitation to buy or sell any financial instrument. See the Risk Disclosure.

3. Your account

You must provide a valid email address and verify it. You are responsible for keeping your password confidential and for all activity under your account. Tell us immediately at contact@theilker.com if you suspect unauthorised use.

Accounts are personal. You may not share, resell or transfer access, or let others use your account.

4. Subscriptions and billing

Paid plans are billed in advance through Stripe on a recurring basis (monthly or annually) until cancelled. Prices are shown before tax; applicable taxes are calculated at checkout.

You can cancel at any time from your account page. Cancellation stops the next renewal; access continues until the end of the paid period. Refunds are governed by the Refund Policy.

We may change prices with at least 30 days' notice by email; the new price applies from your next renewal after the notice period.

5. Acceptable use

You may not: copy, scrape, redistribute, republish or resell data or content from the Service; access it by automated means other than the interfaces we provide; interfere with its security or operation; reverse engineer it; or use it for any unlawful purpose.

Third-party content (news, broadcasts, social posts, market data) remains the property of its owners and is subject to their terms.

6. Availability

Market data, broadcasts and third-party sources can be delayed, interrupted, incomplete or inaccurate. The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, timeliness, fitness for a particular purpose and non-infringement.

7. Limitation of liability

To the maximum extent permitted by law, we are not liable for any trading or investment losses, lost profits, or indirect, incidental, special or consequential damages arising from your use of or reliance on the Service. Our total liability for any claim is limited to the amount you paid for the Service in the 3 months before the claim.

Nothing in these Terms limits liability that cannot be limited by law, or your statutory rights as a consumer.

8. Suspension and termination

We may suspend or terminate accounts that breach these Terms, with a refund only where the Refund Policy or the law requires one. You may close your account at any time by contacting contact@theilker.com.

9. Changes

We may update these Terms. Material changes are announced by email or in the Service at least 14 days before they apply; continuing to use the Service after that means you accept them. The version and date above identify the current text.
